These Terms and Conditions (“Agreement”) govern your use of the website, services, and products provided by Fire Made Designs LLC (“we,” “our,” or “us”). By accessing or using our website and services, including but not limited to custom apparel, technical support, website building, embroidery, laser-etching/engraving, e-store, promotional products, custom gifts, and signage, you agree to be bound by the terms outlined in this Agreement. If you do not agree with these terms, please refrain from using our website or services.
1. Use of Our Services
By purchasing or using any services or products provided by Fire Made Designs LLC, including custom products, technical support, website design, or any other services listed on our website, you agree to abide by the following:
- You agree to provide accurate and complete information when placing an order or engaging with any of our services.
- You acknowledge that you are at least 18 years of age or have obtained consent from a legal guardian if you are under 18.
- You are responsible for the use of our services and products and agree not to misuse or violate any terms of service.
2. Products and Services
- Custom Products: Custom apparel, promotional products, graphic tees, custom gifts, and signage are created according to your specifications. Please ensure all design information, including logos, text, and images, is accurate and final before submitting.
- Technical Support Services: You are responsible for backing up any data before our technical support team works on your devices. We are not liable for data loss, software issues, or hardware malfunctions resulting from using our services.
- Website Building and Maintenance: We will provide website building and maintenance services based on the agreed-upon scope of work in the service contract. Any additional work outside of this agreement may require a new contract.
3. Ordering Process and Payment
- Payment: For custom products or services, payment must be made at the time of order, unless otherwise specified. For technical support, a minimum of 1 hour must be paid upfront (nonrefundable), with the remaining balance due upon completion of the work.
- E-Store Purchases: If you make a purchase through our online store, you agree to pay all applicable prices, taxes, and shipping fees as specified at checkout.
- Order Confirmation: Once an order is placed, you will receive an order confirmation via email. We may contact you if there are issues with your order.
4. Shipping and Delivery
- Delivery Times: We aim to fulfill all orders in a timely manner, but delivery times may vary based on the product type, customization, and shipping method.
- Shipping Charges: Shipping charges will be calculated at checkout and are the responsibility of the customer unless otherwise specified.
- Order Tracking: Once your order is shipped, you will receive a tracking number to monitor the delivery.
5. Returns, Refunds, and Cancellations
- Custom Products: Due to the nature of custom work (including apparel, embroidery, and engraved products), all sales are final. We do not accept returns or offer refunds on custom items unless the product is defective or there is an error on our part.
- Non-Custom Products: For non-custom products, we accept returns within 14 days of receipt, provided the items are unused and in their original condition.
- Cancellations: You may cancel your order for non-custom products within 24 hours of purchase. Once production has begun on custom products, cancellations will not be accepted.
6. Intellectual Property
- Ownership of Work: Fire Made Designs LLC retains ownership of all proprietary work products, designs, code, and documentation unless otherwise agreed upon in a separate contract. You may not copy, reproduce, or modify any content created by Fire Made Designs LLC without written permission.
- Customer Content: You grant Fire Made Designs LLC permission to use your designs, logos, and other materials for the purpose of creating custom products and services as requested. We will not use your content for other purposes without your consent. Occasionally, we may provide bonus, customer-branded items that were not specifically requested to demonstrate additional capabilities and showcase what is possible. These items will not be charged to you and are solely intended as examples.
7. Limitation of Liability
To the fullest extent permitted by law, Fire Made Designs LLC is not responsible for:
- Any loss or damage resulting from the use of our services or products.
- Data loss, hardware failure, or software malfunctions resulting from technical support services.
- Any indirect, incidental, or consequential damages arising from the use of our services.
8. Privacy and Data Protection
We value your privacy. For information about how we collect, use, and protect your personal data, please refer to our Privacy Policy, which is incorporated by reference into this Agreement.
9. Modifications to Terms
Fire Made Designs LLC reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and the revised Terms will take effect immediately upon publication.
10. Governing Law
These Terms and Conditions are governed by the laws of the state in which Fire Made Designs LLC is registered, without regard to its conflict of law principles.
11. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through mediation before seeking legal recourse. If mediation fails, the dispute will be resolved in the appropriate courts in the state where Fire Made Designs LLC is located.
